Information Sharing

Adults have a general right to independence, choice and self-determination including control over information about themselves. The default aim in sharing information is to do so with consent of the person concerned. However, in the context of adult safeguarding, these rights can be overridden in certain circumstances:

    • emergency or life-threatening situations may warrant the sharing of relevant information with the relevant emergency services without consent
    • legislation does not prevent the sharing of sensitive, personal information within If the information is confidential but there is a concern, sharing it may be justified
    • Situational Incapacity is suspected and application to the Courts is being considered under Inherent Jurisdiction
    • legislation does not prevent the sharing of sensitive, personal information between organisations where public interest or vital interest thresholds are met, and these outweigh confidentiality of the information concerned. (Vital Interests and Public Interests are both covered within Data Protection legislation including GDPR).
